The No FEAR Act and Cummings Act: Protecting Whistleblowers and Ensuring Accountability

The No FEAR Act

The Notification and Federal Employee Antidiscrimination and Retaliation (No FEAR) Act of 2002 is a federal law that aims to increase accountability and transparency in the federal government by requiring federal agencies to take proactive measures to prevent discrimination, harassment, and retaliation against employees who report wrongdoing. The No FEAR Act also mandates that federal agencies provide training to employees on their rights and remedies under anti-discrimination and whistleblower protection laws

The Cummings Act

Named in honor of the late Congressman Elijah Cummings, the Elijah E. Cummings Whistleblower Protection Act of 2019 strengthens protections for federal whistleblowers by expanding their rights and remedies, enhancing transparency and accountability, and imposing stricter penalties for retaliation against whistleblowers. The Cummings Act builds upon existing whistleblower protection laws, including the Whistleblower Protection Act and the No FEAR Act, to ensure that federal employees are able to report misconduct and abuses of power without fear of retaliation.
